Understanding New York Payroll Taxes

New York State Income Tax

New York State uses nine progressive income tax brackets for 2026, revised under Chapter 59 of the Laws of 2025. Rates run from 3.90% on the first $8,500 of taxable income up to 10.90% on income above $25 million. The six lower brackets (3.90%–6.85%) apply to the vast majority of workers — only taxpayers with very high incomes reach the 9.65%, 10.30%, or 10.90% top brackets.

Important: New York has a supplemental "tax benefit recapture" provision for income over $107,650 that can effectively push some taxpayers to pay the top marginal rate on all income. New York City Resident Tax — The Third Layer

New York City is one of the few U.S. cities with its own dedicated income tax on residents. The NYC Personal Income Tax has four progressive brackets from 3.078% to 3.876% (2026 — unchanged from 2025). It applies in addition to both federal and NYS income tax, making NYC residents subject to three simultaneous income taxes on the same earnings.

The NYC tax is a resident tax — it applies based on where you live, not where you work. If you live in New Jersey but work in Manhattan, you generally do not owe NYC income tax (though you'd owe NJ state tax on your NJ return). The IT-2104 Form

New York's IT-2104 (Employee's Withholding Allowance Certificate) determines how much New York State and NYC tax your employer withholds. Unlike the current federal W-4 (which dropped allowances in 2020), the IT-2104 still uses an allowance system — each allowance reduces your NYS taxable income by $1,000/year. New York Paid Family Leave (PFL) costs 0.388% of your gross wages in 2026, capped at $399.43/year. Yonkers Local Tax

Yonkers is the only city in New York (besides New York City) with its own resident income tax.
